Communications

Various printed and electronic communications offer you an examination of real estate from many different perspectives.

The Kentucky REALTOR® magazine is the official publication of the Kentucky Association of REALTORS®. This full-color, 32 page magazine is published on a quarterly basis and features the latest in real estate related information and issues designed to help your business succeed. As part of your annual membership dues, the magazine (a $10 value) is automatically delivered to the preferred address on file in the National REALTOR® Database System (NRDS). If you do not receive the magazine, please check your address with your local board/association.

The Real Estate Report is a monthly e-newsletter giving you an in-depth look at factors influencing the industry and your business in Kentucky. The Report features news from across the state and nation as well as tips and tricks to make you more productive and your business more profitable.

Did you know the terms "REALTOR®" and "real estate agent" are not synonymous. The term "REALTOR®" is owned and protected by the National Association of REALTORS®. What is a REALTOR®

A REALTOR® is a licensed real estate professional who is a member of the National Association of REALTORS®, "The Voice for Real Estate" and subscribes to its strict Code of Ethics.

The term REALTOR® is a registered collective membership mark that identifies a real estate professional who is a member of NAR.

Not all real estate agents are REALTORS®.

A licensed professional becomes a REALTOR® by joining the local and state associations of REALTORS®, which entitles automatic membership in NAR, and by subscribing to NAR's Code of Ethics.

There are approximately 2.4 million licensed real estate professionals in the United States, but more than 1 million real estate professionals have taken the additional step to join NAR, "The Voice for Real Estate." When choosing a real estate professional, look for the registered trademark, REALTOR®.

Background

The term REALTOR® was coined in 1916 by a national association official, Mr. Charles N. Chadbourn, a past president of the Minneapolis Real Estate Board. Chadbourn saw the two-syllable term functioning as a collective mark to distinguish members of the national real estate association from nonmembers.

NAR registered the trademarks in 1949 and 1950. They are among the very first trademarks registered after the Lanham Act went into effect.

On March 31, 2004, the United States Trademark Trial and Appeal Board ruled unanimously in reaffirming that the National Association of REALTORS® has exclusive rights to the terms "REALTOR®" and "REALTORS®."

The term REALTOR® designates the highest standards of professionalism and commitment to NAR's strict Code of Ethics and Standards of Practice.

REALTORS® are strong advocates for homeowners and homeownership. NAR is the only national lobbying group that looks out for the interests of homeowners. Every year, NAR leads the way on Capitol Hill and in the corridors of Washington to keep homeownership a top national priority. NAR's support for the mortgage interest deduction and other federal policies helps to keep housing more affordable and makes housing a great investment. Through sound housing policies, more home seekers than ever before are enabled to purchase a home of their own.

The Benefits of Using a REALTOR®

All real estate licensees are not the same. Only real estate licensees who are members of the NATIONAL ASSOCIATION OF REALTORS® are properly called REALTORS®. They proudly display the REALTOR "®" logo on the business card or other marketing and sales literature. REALTORS® are committed to treat all parties to a transaction honestly. REALTORS® subscribe to a strict code of ethics and are expected to maintain a higher level of knowledge of the process of buying and selling real estate. An independent survey reports that 84% of home buyers would use the same REALTOR® again.

Real estate transactions involve one of the biggest financial investments most people experience in their lifetime. Transactions today usually exceed $100,000. If you had a $100,000 income tax problem, would you attempt to deal with it without the help of a CPA? If you had a $100,000 legal question, would you deal with it without the help of an attorney? Considering the small upside cost and the large downside risk, it would be foolish to consider a deal in real estate without the professional assistance of a REALTOR®.

But if you're still not convinced of the value of a REALTOR®, here are a dozen more reasons to use one:

1. Your REALTOR® can help you determine your buying power -- that is, your financial reserves plus your borrowing capacity. If you give a REALTOR® some basic information about your available savings, income and current debt, he or she can refer you to lenders best qualified to help you. Most lenders -- banks and mortgage companies -- offer limited choices.

2. Your REALTOR® has many resources to assist you in your home search. Sometimes the property you are seeking is available but not actively advertised in the market, and it will take some investigation by your agent to find all available properties.

3. Your REALTOR® can assist you in the selection process by providing objective information about each property. Agents who are REALTORS® have access to a variety of informational resources. REALTORS® can provide local community information on utilities, zoning. schools, etc. There are two things you'll want to know. First, will the property provide the environment I want for a home or investment? Second, will the property have resale value when I am ready to sell?

4. Your REALTOR® can help you negotiate. There are myriad negotiating factors, including but not limited to price, financing, terms, date of possession and often the inclusion or exclusion of repairs and furnishings or equipment. The purchase agreement should provide a period of time for you to complete appropriate inspections and investigations of the property before you are bound to complete the purchase. Your agent can advise you as to which investigations and inspections are recommended or required.

5. Your REALTOR® provides due diligence during the evaluation of the property. Depending on the area and property, this could include inspections for termites, dry rot, asbestos, faulty structure, roof condition, septic tank and well tests, just to name a few. Your REALTOR® can assist you in finding qualified responsible professionals to do most of these investigations and provide you with written reports. You will also want to see a preliminary report on the title of the property. Title indicates ownership of property and can be mired in confusing status of past owners or rights of access. The title to most properties will have some limitations; for example, easements (access rights) for utilities. Your REALTOR®, title company or attorney can help you resolve issues that might cause problems at a later date.

6. Your REALTOR® can help you in understanding different financing options and in identifying qualified lenders.

7. Your REALTOR® can guide you through the closing process and make sure everything flows together smoothly.

8. When selling your home, your REALTOR® can give you up-to-date information on what is happening in the marketplace and the price, financing, terms and condition of competing properties. These are key factors in getting your property sold at the best price, quickly and with minimum hassle.

9. Your REALTOR® markets your property to other real estate agents and the public. Often, your REALTOR® can recommend repairs or cosmetic work that will significantly enhance the salability of your property. Your REALTOR® markets your property to other real estate agents and the public. In many markets across the country, over 50% of real estate sales are cooperative sales; that is, a real estate agent other than yours brings in the buyer. Your REALTOR® acts as the marketing coordinator, disbursing information about your property to other real estate agents through a Multiple Listing Service or other cooperative marketing networks, open houses for agents, etc. The REALTOR® Code of Ethics requires REALTORS® to utilize these cooperative relationships when they benefit their clients.

10. Your REALTOR® will know when, where and how to advertise your property. There is a misconception that advertising sells real estate. The NATIONAL ASSOCIATION OF REALTORS® studies show that 82% of real estate sales are the result of agent contacts through previous clients, referrals, friends, family and personal contacts. When a property is marketed with the help of your REALTOR®, you do not have to allow strangers into your home. Your REALTOR® will generally prescreen and accompany qualified prospects through your property.

11. Your REALTOR® can help you objectively evaluate every buyer's proposal without compromising your marketing position. This initial agreement is only the beginning of a process of appraisals, inspections and financing -- a lot of possible pitfalls. Your REALTOR® can help you write a legally binding, win-win agreement that will be more likely to make it through the process.

12. Your REALTOR® can help close the sale of your home. Between the initial sales agreement and closing (or settlement), questions may arise. For example, unexpected repairs are required to obtain financing or a cloud in the title is discovered. The required paperwork alone is overwhelming for most sellers. Your REALTOR® is the best person to objectively help you resolve these issues and move the transaction to closing (or settlement).

With the arrival at Fort Knox of the 3rd Brigade Combat Team, 1st Infantry Division, more than 900 soldiers and their family members have moved into the surrounding communities. The brigade will be at full-strength by spring of 2010, with as many as 3,400 soldiers and their families. In addition, the relocation of the Human Resources Command to Fort Knox will add to a substantial increase in population signifying the importance and demand for quality affordable housing in the area. Many soldiers will opt to reside off-post and, as such, those soldiers, who work extremely hard defending our country, need assurance their families are in good quality, affordable housing.

Local area real estate property owners and managers seeking to advertise their rental property in the Fort Knox community are encouraged to register with the Automated Housing Referral Network (AHRN). AHRN is a Department of Defense website that the Fort Knox Housing Office uses to provide housing to military members and their families. AHRN provides a listing of rental properties that are located within a 60 minutes radius of the military installation.

AHRN is free and easy to use. In addition, pre-approval is not a pre-requisite to register with AHRN. Also, it is not a requirement that real estate property owners and managers be affiliated with the military. Fort Knox is in need of all types of rental listings, to include long term, short term, single family and temporary lodging. In order to register with AHRN, property owners and managers simply need to access the website at www.AHRN.com and follow the directions.

After registering with AHRN, a housing inspector will call to schedule an on-site walk through inspection of the property. Any questions regarding the inspection process should be directed to Madeline Allen (502) 624-5824 Sybil Blevins (502) 624-3548 or Alandra Brown (502) 624-6912.

Sales of single family homes in Kentucky remain strong, with a drop of less than 6% from 2006 to 2007.

MOVING ON

Congratulations! Moving into your new home will most definitely be an exciting time for you and your family. It is, however, a time when you should consider putting in place a well-thought plan to help reduce the level of stress you may experience during the weeks leading up to your move.

MOVING YOURSELF

The first step in any "plan of attack" is to decide if you will move yourself or hire professionals. If you decide that moving yourself is in your best interests, then your first step will be to rent a truck. The size of the truck you rent will depend on a number of things, most notably the extent of your belongings and the distance between your old and new home. The truck rental company can recommend and help you decide the size of the vehicle you'll need.

In addition to the actual cost to rent the truck, be aware that you may be responsible for mileage and additional fees if you decide to accept the company's pads, dollies, blankets, packing materials, and boxes.

Once you've decided on a truck, your next step is to find some movers. Of course, your family and friends will prove invaluable in the loading and unloading of your items from the truck. One potential negative to doing it yourself is an accident. For instance, if someone in your party breaks an item, you would be responsible for replacing it. You can, however, look into purchasing an "insurance rider" to cover your items. Ask your mover or contact your insurance agent for more information about a rider package.

To help avoid accidents and keep your items safe during transport, pack your truck from back to front and bottom to top. And, drive slowly.

BEFORE THE TRUCK RENTAL... CREATE A PERSONAL INVENTORY LIST

Whether you move yourself or choose a professional mover, you should create a personal inventory of all of your belongings - and arrange the list by each room in your home. The list will serve as an important valuation tool should you lose or break any items in your home - or in the unfortunate event your belongings are stolen from you. Your list will also act as a permanent inventory of your valuables for future insurance purposes as well. As such, you should attach any invoices you have saved over the years.

HIRING PROFESSIONAL MOVERS

If you decide to hire a professional mover, your personal inventory list will serve your interests well. For example, when gathering estimates (at least three), you can show the mover everything you plan to move and show the same inventory list to each mover you interview (compare apples to apples).

Movers will most likely quote you hourly rates based on the amount of time it will take to deliver and unload your items. Be aware that you will incur additional fees for packing and unpacking, and disconnecting and hooking up appliances. And, if you're moving to a big city or apartment complex and several flights of stairs or an elevator be involved, expect to pay more. Large items will also raise your costs.

Once you decide which mover best suits your needs, you will receive from that company an "Order For Service" which should include an option of choosing either a binding or non-binding estimate. If you are comfortable with the items you'll be moving and don't expect any major change to the inventory list, then you might consider a binding estimate to lock-in costs. Conversely, if you're unsure, choose a non-binding estimate and expect to pay a bit more.

Upon completion of the move and before paying your movers, make certain to review your "bill of lading" carefully and to keep a copy. The bill of lading may come in handy in the event you have to file an insurance claim and will serve to ensure all of your items were delivered.

KIDS AND MOVING

Change is frightening; the unknown is difficult for any individual to cope with, especially children. To make the move less stressful for both you and your children, set in place a plan that addresses a child's emotional concerns while at the same time gets them actively involved in the move itself.

A few suggestions:

Ask your child how they feel about the move, listen to their feelings and then share your feelings with them. Assure your children that the entire family has to make changes and accept the move.

Allow your children to be a part of the packing and moving stages to keep them actively involved in the process. This allows your children to be independent and to witness first-hand continuity - the move from their old home to their new one.

Give your child her own labels, rubber stamps, pencils, crayons, and encourage her to label her items and boxes, where appropriate. Again knowing her "stuff" is a part of the move allows her to be a part of the process.

Do not pack your child's personal things like her favorite stuffed animal or his video games. That way, there remains a level of comfort the day of the move.

Have a mixer to help your children say good-bye to friends. As you would at a birthday party, take photos, gather addresses and video the event.

Contact the school system and the recreational organization(s) your child is likely to participate in. Get all the information you can and share it with your children.

For your very young children, try not to expect them to accomplish change during the move. For example, during the moving process try not to start toilet training, weaning off of mother's milk or new foods. The added stress of a move won't be good for you or your child.

MOVING CHECKLIST

The following is a list to consider when preparing for your move.

BEFORE YOU LEAVE

Give your forwarding address ASAP to the Post Office (obtain a change of address kit, and complete it), the bank, credit card companies, publication subscriptions, friends and family, insurance carriers - life, auto, death, investments, health care providers, etc.

Inquire about refunds from utility companies like gas, water, electric, telephone, cable, Internet, fuel and garbage. Cancel current service and have new services installed at your new home.

Get your records in order such as arrangements to transfer your children's school records, obtain records from doctors, dentists, lawyers, accountants, etc. Transfer all of your bank accounts to a new branch location.

Keep a record of all expenses related to the move, some of which may be tax-deductible.

Inquire about legislation that may impact your family life. Are there pet regulations for licenses and vaccinations, pool considerations, parking violations, building permits, etc?

Clean, empty or discard your appliances and other household items such as carpets, clothing, furniture, curtains, charcoal grill, refrigerator, flammable household aerosol cleaning supplies, etc.

Finalize details with moving company.

Provide your family and friends with a travel route, moving plan and inventory list.

Secure your pre-packing materials such as Furniture pads, crumpled newspapers, hand truck, scissors, dolly, utility knife, packing tape, bubble wrap, Styrofoam peanuts, boxes (did I say boxes?), markers, labels, string and/or rope.

If you've hired a professional mover or are doing it yourself, have the packing completed before loading the truck. Will you need additional storage at your new location?

Hold a "we're moving" garage sale.

Have your car checked by a professional. Alert the technician that you're moving and need your car in appropriate condition.

Pack a "moving day" box for instant needs on arrival. Mark the box "To be loaded last and unloaded first." Package each group of items separately in labeled paper bags.

MOVING DAY

Make sure your mover (or friends/family) has the exact address and proper directions to your new home.

Have enough cash or travelers checks in hand to cover costs of moving and expenses until you finalize paperwork with your new financial institutions.

Keep your expensive jewelry or other smaller, expensive items on your person.

Is your pet cared for?

Take one more "walk-through" of the home.

Leave your old keys needed by new tenants or owners with REALTOR® or owner. Lock all doors and windows.

Inspect all boxes coming off the truck. You should itemize them on your inventory list.

Install new locks.

Check your utilities to make sure they are properly connected.

AT YOUR NEW ADDRESS

Register to vote!

Register your car - or you may be hit with a fee!

Register your family in your new place of worship.

Make certain your home is in proper working order. Check appliances, pilot light on stove and water heater. Make a phone call, take a shower, heat food in the microwave.

Have your funds ready for closing.

Go to your new post office or ask mailperson if any of your mail is being held.

Have your licenses - any and all - reflect your new address.

Align yourself with new professionals, if necessary - dentist, doctor, accountant, veterinarian.

The real estate profession offers one of the widest career selections in the business world today. Helping people buy and sell homes, office buildings, industrial property and corporation farmland, property management, land development, mortgage banking, urban planning, real estate counseling, appraisal and research are all aspects of a career in real estate.

Working in real estate allows for independence, a flexible work schedule and the unlimited earning potential that sales positions can offer. It is, however, definitely not a career for those who like the routine of a nine-to-five job. There are no "punch clocks," or an official "quitting time." Your phone can ring at any time of the day or night.

Successful people in real estate are goal-oriented, persevering, self-motivated and ambitious. They are also people who derive personal satisfaction from delivering the American Dream of Homeownership to families and individuals alike.

Real estate also offers you choice. For example, you can choose the environment in which to work, such as an affiliation with a large or small firm or whether to partner with a seller or a buyer. With more experience and upon passing of an additional exam, you can then choose to become a real estate broker. As a broker, you can own your own business and employ other salespeople.

BECOMING A REALTOR®

The Kentucky Association of REALTORS® is the state's largest real estate professional organization, representing more than 10,000 members. The term REALTOR® is a registered and protected trademark. A REALTOR® is a member of the National Association of REALTORS®, a state association of REALTORS® and their local Board of REALTORS®. By joining the REALTOR® organization, a real estate professional has to adhere to a strict Code of Ethics and its standards of professionalism, integrity and competence.

REAL ESTATE LICENSING

Entry into the real estate profession takes preparation and relies heavily on education, training and personal/professional interests. Real estate professionals need to have a thorough knowledge of such areas as real estate law, local economics, and fair housing laws, types of financing, mortgages and government programs.

As with other professions, licensing is required. All Kentucky real estate professionals are licensed by the state. To get your real estate license, you must first complete the required education and pass the licensing examination. This online and classroom 96 hour salesperson pre-license course is approved by the Kentucky Real Estate Commission (KREC). Cost: $550.

Licensing Information and Qualifications

Before you agree to take this course, keep in mind to obtain a real estate license in Kentucky, you must:

Be 18 years of age

Have attained a high school diploma or G.E.D. equivalency. Candidates who completed at least 28 credit hours from a post secondary institution may submit a copy of the transcript in lieu the high school or G.E.D. diploma.

Have completed six semester credit hours in real estate courses from an accredited college or university OR 96 classroom hours in real estate courses from a Kentucky approved Proprietary School. Courses must be completed prior to taking the real estate examination.

All persons who will be taking the sales examination must submit to a criminal background check. Go to www.krec.ky.gov and see document #408 for a complete explanation of this requirement. DO THIS NOW! It can take up to 3 months to complete this process

Contact the Kentucky Real Estate Commission or go to their website at www.krec.ky.gov to receive more detailed information.

Purchasing of Course

Students must purchase the full package course which includes online and classroom learning. The Kentucky Association of REALTORS® will be notified once you have purchased the course and a packet of information will be mailed to you prior to the course start date.

Once you've registered you may begin the online portion at that time. The online portion does not have to be completed before the classroom portion.

Payment: The cost of the course is $550.00. The course must be paid for at the time of purchase with a credit card – no checks or payment plans are available.

Time Frame

You have 1 year to complete the online hours, which will consist of the National Real Estate Principles. We recommend you take the classroom hours when they are offered, which will consist of the Kentucky Real Estate Law.

Please check our website periodically to see when the next classroom portion is being offered. Both set of hours have to be completed and passed with a 75% before a completion certificate is issued.

Your online course will be activated for 1 year – you must complete the course in its entirety (tutorial, lessons, units, classroom hours and final exam) by your expiration date ( 1 year the day and time of purchase) to receive a certificate of completion. No extensions can be granted.

Confirmation Packet

A confirmation email will be sent 5 days before the class is held. Included in this email is instructor contact information, a how to sign-up for the exam, classroom course schedule a Student Affidavit to ensure your correct name is on your certificate of completion, step-by-step directions on what you need to do to become a licensed real estate salesperson in Kentucky. The Modern Practices of Real Estate book is available the first day of class. If you would like a copy mailed to you prior to, please email bbaxter@kar.com.

Course Information

To complete the salesperson course, you must complete:

- 60 hours online which includes (every unit, exercises and unit exam).

- 36 hours in the classroom (please contact our office to confirm the dates and times you will be attending.

- Comprehensive Final Examination (online material and classroom material) with 75% correct.

Your instructor is your resource for questions regarding course content. You will be notified by email 5 days before the class of your instructor’s name and contact information. Should you wish to contact the instructor prior to receiving this information, please contact the KAR at 800-264-2185.

Course Completion

Upon completion and passing of the online hours and classroom hours the Kentucky Association of REALTORS® will be notified and your certificate of completion will be issued by mail within three business days of course completion. You must attach the certificate of completion to your license application – DO NOT LOSE YOUR CERTIFICATE.

Course Review

You may review any portion of the course you have completed within your 1 year timeframe – even after you have received your certificate of completion. The course will be available to you throughout your 1 year time-frame.

Refunds/Cancellation Policy

Once you register for a course, you can begin immediately. The courses may be entered and exited at your convenience. If a student drops out of the course within 30 days they will receive a refund of $515 and will have to pay the full amount to re-register for the full course. Beyond 30 days no refund is available (please keep in mind you will have 12 months to complete the course).

RECampus, the company that houses the course, provides technical support for students who have questions or problems with their web browser or the technical side of the course. Technical support hours are: Monday-Friday, 8AM to 9PM and Saturday-Sunday, 8AM to 7PM Central Time. Each course is a 16 hour (two day) course except the elective courses which are each 8 hour (one day) courses. Would you like to join the ranks of some of the most successful REALTORS® from around the state? You can by becoming part of the LeadershipKAR program, offered by the Kentucky Association of REALTORS® since 2002. Recognizing that leadership development is an essential element in the process of improving our Association and profession, KAR attempts to identify emerging REALTOR® leaders in the state, encourage them with motivational activities and assist in sharpening their leadership skills in the hope they will exert a strong positive influence on the future of the Association and profession.

The program allows participants to work together in a training course which combines individual study, group sessions and actual project experience in using leadership skills. Training sessions include identification of leadership skills, team-building exercises, goal setting, personal profile analysis, network building and improving communication skills. In total, there are six (6) sessions – three (3) KAR business meetings and three (3) retreats.

LeadershipKAR is open to all REALTOR® members of KAR, however, a maximum of 15 individuals will be appointed to participate in the program. Participants will be chosen from a cross-section of the profession and will reflect the diversity of the organization.

Please note: attendance at all sessions (retreats and KAR meetings) is mandatory. The dates for all sessions are listed on the application.

Objectives of the LeadershipKAR program are:

To identify Kentucky REALTORS® who have demonstrated leadership potential through job-related and  community activities.

To train participants by developing leadership skills.

To motivate participants by:
      - Increasing awareness of real estate and association management issues and challenges
      - Involvement in problem-solving activities on issues of current interest; and
      - Providing a network of leaders

The Kentucky Real Estate Education Foundation (KREEF) was incorporated in March 1990 to serve as the educational arm of the Kentucky Association of REALTORS®. The Foundation is dedicated to providing education, services and research for members of the Kentucky Association of REALTORS®, Kentucky real estate licensees and the public.

The Trustees of the Foundation are continuously reviewing the potential to determine various meaningful projects with one important endeavor being annual scholarships.

As such, KREEF makes scholarships available to members to continue education and obtain the GRI designation as well as provide scholarships to members or to the immediate family of members who wish to further their education.

The KREEF Trustees award scholarships on an annual basis depending on a variety of factors. The total number of scholarships awarded will be determined by the Trustees.

KAR’s Top Legislative Priorities

HB 78 – Sales Tax on Services (OPPOSE)
Applying the sales tax to real estate services is likely to reduce the demand for housing by effectively increasing the cost of purchasing a home. The total impact is based on several reinforcing effects:
· Increased closing costs on the transfer of existing residential and nonresidential property
· Increased cost of operating a brokerage business
· Increased cost of new single family and multifamily housing
· A 6% sales tax could have the same impact as raising the mortgage rate by .75%
· This is a regressive tax and has the highest impact on those who can least afford it

HB 112 – Local Taxation of Businesses (SUPPORT)
HB 112 will exempt any proceeds derived by a business entity from the transfer or sale of business property from the definition of "gross receipts" and "net profit" for purposes of local net profits, gross receipts, and occupational license taxes. This bill is a clean-up bill that addresses issues from a bill passed in 2003.

HB 353 – Centralized Revenue Collection (SUPPORT)
This bill will develop and administer a Web-based system for the centralized reporting and collection of local occupational license taxes and fees. The system must have the ability to:
· accommodate the payment and reporting of license and occupational taxes imposed against businesses on business income; and occupational taxes withheld by employers from wages paid to employees
· Report and pay all local/county occupational license taxes and fees in one transaction with automatic distribution of payment to each local/county government entity

IMPORTANT (Bills KAR will monitor closely)

SB 66 – Regulation of Appraisal Management Companies (SUPPORT with amendment)
Senate Bill 66 defines terms related to the regulation and registration of real estate appraisal management companies. KAR recommends the language of Section 5(2)b be stricken. This section would not allow an AMC to hire, employ, or in any way contract with or pay a real estate broker to perform a broker's price opinion or comparative market analysis to be used in lieu of a requested appraisal. KAR is opposed to this bill unless the above changes are made.

SB 96 – Real Estate Licensure sex crimes (SUPPORT)
SB 96 relates to real estate licensure and would deny licensure for applicants convicted of a sex crime and would revoke the license of person convicted of a sex crime.

HB 348 – Comprehensive Environmental Status Reviews (OPPOSE)
HB 348 would require a “Comprehensive Environmental Status Review” where a planning body is creating or considering a comprehensive plan, a plan amendment, a land use or zoning regulation, a subdivision regulation, a public improvements program, etc. The bill includes the following language, “The comprehensive plan shall not authorize development in a location or manner that causes or contributes to violations of the general laws prohibiting air, land, and water pollution.” The requirements of this measure are extensive and include reviews of air, land and water pollution, among other issues. Overall, this bill, if enacted, has the potential to at least delay and ultimately deny any new development.

HB 356 – KREC Bill / Real Estate Brokers and Salesmen (SUPPORT)
This is an administrative bill that will:
· Require annual license renewal on a date specified by KREC through administrative regulations
· Increase from 50 to 100 miles the radius outside of which a principal broker is required to have a broker managing a branch office
· Require licensees to provide phone numbers and emails during annual renewal
· Increase from 60 to 120 days after the end of the fiscal year the time frame within the commission shall make public income and expenses from the real estate education, research, and recovery fund.

HB 357 – KREC Bill / Real Estate Compensation (this bill has been WITHDRAWN)
· This bill will exempt employees of builders or developers who receive bonuses for sale of property and employees of property managers who receive bonuses for property management from the definition of "regular employee"
· This bill also expands forms of compensation that would require a seller to issue a seller's disclosure of conditions form.

HB 394 – New Home Tax Credit (SUPPORT)
This bill will allow qualified buyers of new homes to utilize the new home state tax credit of up to $5,000 in conjunction with the Federal First Time Home Buyer Tax Credit of $8,000 for first time home buyers and $6,500 for repeat home buyers.

SIGNIFICANT (Bills KAR will monitor)

HB 123 – Contracts
HB 123 will require consumer contracts with an automatic renewal clause have the clause conspicuously displayed in the contract and require that notice of an upcoming renewal period be sent to the consumer.

HB 219 – Crimes and Punishments (Auction Escrow Account)
HB 219 relates to theft by deception to include the issuance of a check with knowledge that it will not be honored by the drawee for the lease, rent, or purchase of property, or for payment to an auction escrow account.

HB 362 – Energy Star Tax Credit
HB 362 expands the ENERGY STAR Tax Credit, making it available to S-Corporations, Pass-Through’s, LLC’s and LLP’s.

HB 391 – Condominiums
HB 391 relates to condominiums and the Uniform Condominium Act. This bill defines relevant terms, provides requirements and procedures for establishment of associations and for the conduct of business. This bill also establishes rights and responsibilities of unit owners, provides criteria related to the sale of units by unit owners and collection of delinquent fees and assessments.

HB 454 – Utility Lien
This bill would authorize utilities that provide gas, electric, sewer or water service to retail business customers to impose a lien on their property for any outstanding charges and fees when utility bill is in arrears in excess of $50,000. This lien would take priority over a mortgage, contract lien, or bona fide conveyance under specific conditions.

HB 465 – Residential Property
This bill will require a creditor to register vacant residential property with the local government in which the property is located and will create a penalty for failure to comply.

HB 494 – Radon Professionals
This bill is relating to radon professionals and making an appropriation thereof. This bill would require certification and regulation of radon measurement professionals, mitigation professionals, and radon laboratories as well as establish the Kentucky Board of Radon Professionals and its appointment and meeting procedures.

HB 496 – Judgment Liens
This bill is relating to judgment liens on real property to provide that where the real property is under joint ownership, the lien shall not extend beyond the interest held by the debtor.

GENERAL (Bills listed for informational purposes)

HB 298 – Collection of Property Taxes
This bill is intended to clean up some processes that were established in last year's HB 262. This all relates to stabilizing the 3rd party purchase of delinquent tax bills.

The State Political Coordinator (SPC) Network seeks to match REALTORS® with their State Senator and Representative in a positive, one-on-one relationship. The intent is to maintain, enhance and foster high quality, local REALTOR® contacts for State Senators and Representatives regarding real estate issues in Kentucky.

When a key issue is being considered in the General Assembly, specific members of the SPC Network will be mobilized to relay the industry's position to their designated legislator. Through the use and development of personal relationships with Kentucky legislators, we can put a local and personal touch to our legislative advocacy.

Professional Standards & Mediation Services

Professional standards provides our members information on issues relating to the NAR Code of Ethics and how KAR handles the Professional Standards Process for local REALTOR® Associations. Professional standards makes recommendations to KAR’s Board of Directors on policy decisions relating to many of the items listed as follows:

Professional Standards Process

KAR abides by the Professional Standards Agreement signed by all of the 28 local boards. KAR handles the administrative paperwork for all Ethics Complaints and Arbitration Requests from Boards for all Option A Boards (Boards who delegate the administrative responsibilities to KAR). Currently 26 of 28 local boards use KAR for the process.

Professional Standards Training

This is mandatory annual training for KAR members serving on the Professional Standards Committees. The training consists of approximately six hours of instruction and in three locations across the state. This training is necessary and mandatory for committee members to remain up-to-date on Professional Standards procedure and policy.

Association Executive Professional Standards Training/Materials

KAR provides updated “Ethics & Arbitration Kits” (forms to mail to someone wanting to file either an ethics complaint or arbitration request) and procedures for individuals wishing to utilize the Professional Standards process. KAR invites all AE’s to attend the annual training session and also provides a copy of the most recent Pro. Stds. Reference Manual used in training professional standards committee members to ensure that all Association Executives have a thorough overview of the Professional Standards process.

Mediation Training Course

The purpose of the one-day intensive training course and follow-up annual refresher courses is to train KAR members to serve in the capacity as Mediators in dispute resolution. It is necessary to have trained qualified mediators to offer as an option in the KAR Professional Standards process as required by NAR®.

Mediation Program & Brochure

Mediation is offered as a service in the KAR Professional Standards process as an alternative to the formal Arbitration hearing and as a tool for dispute resolution for arbitration requests forwarded to a hearing by the Grievance Committee.

NAR Professional Standards Training Scholarships

This scholarship sends two KAR members to the Annual NAR Professional Standards Training in Chicago for additional training in Professional Standards procedure and policy.

Education Classes

We work with NAR and KREEF to provide information about educational opportunities to REALTORS® on the Code of Ethics. NAR requires every REALTOR® member must successfully complete an ethics class of at least 2 hours and 30 minutes. Failure to complete the required ethics training shall be considered a violation of a membership duty for which the REALTOR® membership shall be suspended and membership terminated if the required training is not completed.

Filing an ethics complaint or arbitration request as a REALTOR® member or a member of the public

The Kentucky Association of REALTORS® ensures the ethical behavior of its REALTOR® members through the professional standards process. A complaint/request can only be processed against someone who is a member of our association and his/her membership will need to be verified in our association. Although the staff of KAR is not at liberty to offer any advice on the merits of your complaint, there are several options to consider:

Filing an Ethics Complaint

An ethics complaint may be filed by anyone who believes a REALTOR® has violated the Code of Ethics. Any complaint reviewed by the Grievance Committee must site a specific article(s) and include a statement as to why that article(s) has been violated given the facts and circumstances of the particular case. Note the complaint must be filed within 180 days (not 6 months) after the facts become known or could have been known in the exercise of reasonable diligence.

Filing a Request for Arbitration

A request for arbitration may be filed if a contractual relationship exists between two parties and involves a specific monetary amount, which will either be awarded to one of the parties involved or split between the two parties. Note that parties subject to arbitration must agree to be bound by the award. Also the request must be filed within 180 days (not 6 months) after the facts became known or the closing of the transaction, whichever is later.

Please be reminded it is important to attach an explanation of the situation surrounding the complaint/request. Be as specific as possible. Provide any information that would assistant the grievance committee in understanding the facts in the situation and making an informed decision. NEW 2009-2010 Federal Home Buyer Tax Credit Information

In the hopes of continuing the upward swing of the national real estate market, the recent expansion and extension of the home buyer tax credit has made more than two-thirds of current homeowners and nearly all first-time buyers eligible for the credit when they purchase a home. The credit is part of the Worker, Homeownership, and Business Assistance Act of 2009, a $24 billion economic stimulus bill that is envisioned to address the economic challenges facing our nation while also energizing the U.S. housing market.

The newly passed legislation does two things:
• Extends the First-Time Home Buyer Tax Credit of up to $8,000 to first-time home buyers until April 30, 2010.
• Expands the credit to grant up to $6,500 credit to current home owners purchasing a new or existing home between November 7, 2009 and April 30, 2010.

For homes purchased between January 1, 2009 and November 6, 2009, the qualifications for the tax credit may vary. If you have specific questions or need additional information, please contact a tax professional or the Internal Revenue Service at 800-829-1040.

Keynote Speaker - John Tuccillo

John Tuccillo is one of the foremost real estate and housing finance economists in the United States. His current consulting practice is focused on strategic and business planning, and his experience and counsel are sought out by trade associations, major real estate and other private firms. His presentations on the economic outlook, real estate markets and change in the real estate business are invariably witty, informative and accessible to both lay and professional audiences.

He was educated at Georgetown University and Cornell University, and holds a doctorate in economics. His books, The Eight New Rules of Real Estate and Click and Close (written with Jim Sherry), are best sellers and have been instrumental in shaping the thinking of real estate industry leaders as they approach the challenge of changing their business models. His new book, New Business Models for the New Economy, was released in November 2002.

From 1987 to 1997 he was Chief Economist for the National Association of Realtors. He now runs his own consulting business, JTA, LLC, specializing in strategic and business planning. His clients have included Fannie Mae, Microsoft, FNIS, GMAC, Prudential Real Estate Associates, Re Max, Cendant, Ellie Mae, and a host of large independent real estate firms, as well as state and local Realtor associations.

He is a regular columnist for The Real Estate Professional.

Kentucky Open House Weekend
April 10 - 11

The Kentucky Association of REALTORS® has teamed up with associations across the country for one weekend of Nationwide Open Houses. The purpose is to encourage those who are thinking of buying a home to take advantage of unique home market factors and the federal first-time home buyer tax credit that expires on April 30th. This is the first event of its kind nationwide.

Be sure to include your open houses for that weekend on the MLS and in other promotions you are putting together! We'll be directing the public to this website and you can direct them to your listings on the MLS or personal sites as well. This is at no cost to you! KAR will be sending free balloons to your local association, available for you to tie to your open house signs and will be providing free graphics, flyers and ads available for download below. NAR will be promoting the event on a national level.

The Kentucky Association of REALTORS® (KAR), Inc. is one of the largest and most influential associations in Kentucky. Founded in 1923, KAR represents more than 10,500 REALTORS® who are involved in all aspects of real estate, including residential and commercial real estate brokers, sales agents, developers, builders, property managers, office managers, appraisers and auctioneers.

The Kentucky Association of REALTORS® serves as a conduit to growth, knowledge and professionalism for its members and the real estate industry as a whole. The Association is committed to delivering its members the very finest tools and information to help them succeed - and to meet the needs of today's property buying and selling consumers.

As "The Voice for Real Estate™ in Kentucky," a primary value of KAR is to serve and represent its members in regulatory and legislative matters; to keep the REALTOR® central to the real estate transaction; to promote member integrity, competency and responsible citizenship; and to advocate and protect private property rights and equal housing opportunity.

All KAR members belong to one or more of the 28 local REALTOR® associations statewide and the National Association of REALTORS®. As members of organized real estate, REALTORS® subscribe to a strict Code of Ethics, which ensures the highest level of professionalism.

History

A group of individuals from throughout Kentucky joined together for the purpose of exchanging property information. They discussed properties for sale and shared ideas about real estate. It is from this informal idea exchange that began the statewide organization created to unite those engaged in the real estate business in the community and to promote good fellowship and fair dealings among its members and clients. In 1923, the organization received its original charter from NAR, known as the Kentucky Association of REALTORS® for the purpose of observing and enforcing the Code of Ethics of NAR. KAR's first President was Barney J. Treacy of Lexington. Today, the 10,000 members of the Kentucky Association of REALTORS® (KAR), the "Voice for Real Estate™" in Kentucky, works to preserve and enhance the rights and privileges of the owners of private property. The Association also exists to support and enhance the ability of local Board members to succeed in their business in an ethical and competent manner. Since its inception in 1923, KAR has worked successfully to advance home ownership, real estate investment, private property rights and the free enterprise system in the halls of Frankfort - the state Capital - and with public officials from local and county agencies throughout Kentucky.

Today, the Kentucky Association of REALTORS® is widely recognized as one of the state's strongest, most effective lobbying organizations, supported by the National Association of REALTORS®, the largest trade association in the country with more than 1 million members with 54 State Associations (including Guam, Puerto Rico, and the Virgin Islands) and more than 1,500 local Associations nationwide.

An important aspect of the many successes earned by the Kentucky Association of REALTORS® over the years is its many volunteers who have contributed time and energy to the state organization. To list all the names over the years would create volumes. However, the Kentucky Association of REALTORS® is proud to recognize a distinguished group of volunteers, our Past Presidents, who have dedicated at least a year from their real estate practice to serve as the chief officer of our organization, and our REALTOR®-of-the-Year honorees, who have made significant contributions to their careers, their industry and the community at-large. Many times these individuals served on a number of committees as members and chairmen.

A HISTORY OF THE NATIONAL ASSOCIATION OF REALTORS®

The founding of the REALTOR® organization must first begin with a brief history of the "National Association of Real Estate Exchanges," now known as the National Association of REALTORS®. On May 12, 1908, 120 men representing 19 boards in 13 states and one state association (California) met in Chicago to "unite the real estate men of America" for the purpose of effectively exerting a combined influence upon matters affecting real estate interests. Making use of the "Golden Rule" as its theme, the REALTORS® adopted a strict Code of Ethics. The Code was first adopted as "Rules of Conduct" to be recommended to real estate boards for voluntary adoption. Compliance with the Code was made a condition of membership in the National Association in 1924, and has remained so to date. The national association was the second trade or business group in the United States to follow examples of the professions of medicine, law and engineering in formulating a Code of Ethics for its members. In 1916, the term REALTOR® was adopted to identify real estate agents who are members of the National Association of REALTORS® and subscribe to its strict Code of Ethics.

In 1972, NAR's present "®" logo was adopted. With over 400,000 sales associates in 1972, NAR became the largest trade association in the country. Throughout NAR's history, it has been working for America's property owners, exerting pressure on government for better housing standards, improved home financing, the prevention of real estate fraud, the reduction of deficit spending, community revitalization, protecting private property rights and fair taxation.

Today, NAR is more than 1 million members strong and is recognized as the largest trade association in the country. Read more about NAR's Green Building in Washington, D.C.

2009 REALTOR® of the Year

Ann McDonald, broker of three real estate offices in Winchester, Georgetown and Richmond for Coldwell Banker McMahan and a member of the Lexington-Bluegrass Association of REALTORS® (LBAR), was named KAR’s 2009 REALTOR® of the Year. McDonald serves on the board of directors for the Kentucky Association of REALTORS® and is also serving as region IV director. She currently serves as a state political coordinator and is involved with the legal action fund task force and strategic planning committee. On the local level, McDonald served as president of the Lexington-Bluegrass Association of REALTORS® (LBAR) in 2005, was awarded REALTOR® of the Year in 2007 and has served on the LBAR board of directors and RPAC committee. For many years, she has attended national REALTOR® meetings, leading LBAR to Washington to meet with senators and representatives to discuss important issues affecting the real estate industry. McDonald serves her community as a member of the Lexington, Winchester and Richmond Chambers of Commerce. In addition, she has attended past Commerce Lexington trips to other cities and also participates in “fly-ins” to Washington.

2009 Distinguished Service Award

The 2009 KAR Distinguished Service Award went to Evelyn Pusateri, a member of the Greater Louisville Association of REALTORS® (GLAR). This award is given to someone who has provided outstanding contributions and service to the real estate industry and his/her local community. Pusateri began her real estate career as a REALTOR® 38 years ago and has been serving the Louisville area ever since. She was named REALTOR® of the Year for GLAR in 1988 and was awarded the same honor in the same year for KAR. In 1992, she served as president of KAR. Pusateri was the GLAR recipient of the John R. Carpenter Award for community service in 1999 and in 2004 was placed on the GLAR Wall of Honor. She has served in nearly every capacity at the local level including president in 1989, the board of directors and committees such as finance, professional standards, leadership development and education. Pusateri served the National Association of REALTORS® as a director for nine years and various other committees since. She was part of the GLAR Extreme Makeover Team and is an active participant in “Second Chance at Life” organ donation program.

Association Executive

Northern Kentucky Association of REALTORS® is seeking a seasoned Association Executive (AE) to help implement a strategy that addresses an evolving industry and the public policy environment in which it operates for an association of approximately a 1000 members.

This highly visible AE will work with an energized volunteer membership and lead the staff to enhance the public's perception of the industry. The successful candidate must have proven Association experience, demonstrated leadership abilities, strong management skills, and political acumen. S/he must be an energetic strategic thinker, leader, administrator, manager and communicator. Personal characteristics such as vision, excellent judgment, high integrity, principled decision-making and a commitment to teamwork are necessary. Must have strong business skills, at least 5 years of experience and education in association management, or an equivalent discipline necessary. Bachelors Degree preferred. REALTOR® association Certified Executive (RCE) and/or Certified Association Executive (CAE) designations preferred.
