<strong>Licensing Information and Qualifications </strong><br />
<br />
<em>Before you agree to take this course, keep in mind to obtain a real estate license in Kentucky, you must:</em><br />
<br />
Be 18 years of age<br />
<br />
Have attained a high school diploma or G.E.D. equivalency. Candidates who completed at least 28 credit hours from a post secondary institution may submit a copy of the transcript in lieu the high school or G.E.D. diploma.<br />
<br />
Have completed six semester credit hours in real estate courses from an accredited college or university OR 96 classroom hours in real estate courses from a Kentucky approved Proprietary School. Courses must be completed prior to taking the real estate examination.<br />
<br />
All persons who will be taking the sales examination must submit to a criminal background check. Go to <a href="http://www.krec.ky.gov/">www.krec.ky.gov</a> and see document #408 for a complete explanation of this requirement. <strong>DO THIS NOW!</strong> It can take up to 3 months to complete this process<br />
<br />

Purchasing of Course</strong><br />
<br />
Students must purchase the full package course which includes online and classroom learning. The Kentucky Association of REALTORS® will be notified once you have purchased the course and a packet of information will be mailed to you prior to the course start date.<br />
<br />
Once you've registered you may begin the online portion at that time. The online portion does not have to be completed before the classroom portion.<br />
<br />
Payment: The cost of the course is $550.00. The course must be paid for at the time of purchase with a credit card – no checks or payment plans are available.<br />
<br />
<strong>Time Frame<br />
<br />
</strong>You have 1 year to complete the online hours, which will consist of the National Real Estate Principles. We recommend you take the classroom hours when they are offered, which will consist of the Kentucky Real Estate Law. <br />
<br />
Please check our website periodically to see when the next classroom portion is being offered. Both set of hours have to be completed and passed with a 75% before a completion certificate is issued. </p>
<div>Your online course will be activated for 1 year – you must complete the course in its entirety (tutorial, lessons, units, classroom hours and final exam) by your expiration date ( 1 year the day and time of purchase) to receive a certificate of completion. No extensions can be granted.<br />

<strong>Course Completion<br />
</strong><br />
Upon completion and passing of the online hours and classroom hours the Kentucky Association of REALTORS® will be notified and your certificate of completion will be issued by mail within three business days of course completion. You must attach the certificate of completion to your license application – DO NOT LOSE YOUR CERTIFICATE.<br />

<strong>Course Review</strong><br />
<br />
You may review any portion of the course you have completed within your 1 year timeframe – even after you have received your certificate of completion. The course will be available to you throughout your 1 year time-frame.<br />
<br />
<strong>Refunds/Cancellation Policy<br />
<br />
</strong>Once you register for a course, you can begin immediately. The courses may be entered and exited at your convenience. If a student drops out of the course within 30 days they will receive a refund of $515 and will have to pay the full amount to re-register for the full course. Beyond 30 days no refund is available (please keep in mind you will have 12 months to complete the course).<br />

Each course is a 16 hour (two day) course except the elective courses which are each 8 hour (one day) courses. The total classroom time equals 96 hours and must be completed within 5 years of starting the program. Would you like to join the ranks of some of the most successful REALTORS® from around the state? You can by becoming part of the LeadershipKAR program, offered by the Kentucky Association of REALTORS® since 2002. Recognizing that leadership development is an essential element in the process of improving our Association and profession, KAR attempts to identify emerging REALTOR® leaders in the state, encourage them with motivational activities and assist in sharpening their leadership skills in the hope they will exert a strong positive influence on the future of the Association and profession.<br />

The program allows participants to work together in a training course which combines individual study, group sessions and actual project experience in using leadership skills. Training sessions include identification of leadership skills, team-building exercises, goal setting, personal profile analysis, network building and improving communication skills. In total, there are six (6) sessions – three (3) KAR business meetings and three (3) retreats. <br />
<br />
LeadershipKAR is open to all REALTOR® members of KAR, however, a maximum of 15 individuals will be appointed to participate in the program. Participants will be chosen from a cross-section of the profession and will reflect the diversity of the organization. <br />
<br />
<em>Please note: attendance at all sessions (retreats and KAR meetings) is mandatory. The dates for all sessions are listed on the application.</em><br />

<p>The Kentucky Real Estate Education Foundation (KREEF) was incorporated in March 1990 to serve as the educational arm of the Kentucky Association of REALTORS®. The Foundation is dedicated to providing education, services and research for members of the Kentucky Association of REALTORS®, Kentucky real estate licensees and the public.<br />

The Trustees of the Foundation are continuously reviewing the potential to determine various meaningful projects with one important endeavor being annual scholarships. <br />

As such, KREEF makes scholarships available to members to continue education and obtain the GRI designation as well as provide scholarships to members or to the immediate family of members who wish to further their education.<br />

<p><strong>KAR’s Top Legislative Priorities</strong><br />
<br />
HB 78 – Sales Tax on Services (OPPOSE)<br />
Applying the sales tax to real estate services is likely to reduce the demand for housing by effectively increasing the cost of purchasing a home. The total impact is based on several reinforcing effects:<br />
· Increased closing costs on the transfer of existing residential and nonresidential property<br />
· Increased cost of operating a brokerage business<br />
· Increased cost of new single family and multifamily housing <br />
· A 6% sales tax could have the same impact as raising the mortgage rate by .75%<br />
· This is a regressive tax and has the highest impact on those who can least afford it<br />
<br />
HB 112 – Local Taxation of Businesses (SUPPORT)<br />
HB 112 will exempt any proceeds derived by a business entity from the transfer or sale of business property from the definition of "gross receipts" and "net profit" for purposes of local net profits, gross receipts, and occupational license taxes. This bill is a clean-up bill that addresses issues from a bill passed in 2003.<br />
<br />
HB 353 – Centralized Revenue Collection (SUPPORT)<br />
This bill will develop and administer a Web-based system for the centralized reporting and collection of local occupational license taxes and fees. The system must have the ability to:<br />
· accommodate the payment and reporting of license and occupational taxes imposed against businesses on business income; and occupational taxes withheld by employers from wages paid to employees<br />
· Report and pay all local/county occupational license taxes and fees in one transaction with automatic distribution of payment to each local/county government entity<br />
<br />
<strong>IMPORTANT (Bills KAR will monitor closely)</strong><br />
<br />
SB 66 – Regulation of Appraisal Management Companies (SUPPORT with amendment)<br />
Senate Bill 66 defines terms related to the regulation and registration of real estate appraisal management companies. KAR recommends the language of Section 5(2)b be stricken. This section would not allow an AMC to hire, employ, or in any way contract with or pay a real estate broker to perform a broker's price opinion or comparative market analysis to be used in lieu of a requested appraisal. KAR is opposed to this bill unless the above changes are made.<br />
<br />
SB 96 – Real Estate Licensure sex crimes (SUPPORT)<br />
SB 96 relates to real estate licensure and would deny licensure for applicants convicted of a sex crime and would revoke the license of person convicted of a sex crime.<br />
<br />
HB 348 – Comprehensive Environmental Status Reviews (OPPOSE)<br />
HB 348 would require a “Comprehensive Environmental Status Review” where a planning body is creating or considering a comprehensive plan, a plan amendment, a land use or zoning regulation, a subdivision regulation, a public improvements program, etc. The bill includes the following language, “The comprehensive plan shall not authorize development in a location or manner that causes or contributes to violations of the general laws prohibiting air, land, and water pollution.” The requirements of this measure are extensive and include reviews of air, land and water pollution, among other issues. Overall, this bill, if enacted, has the potential to at least delay and ultimately deny any new development.<br />
<br />
HB 356 – KREC Bill / Real Estate Brokers and Salesmen (SUPPORT) <br />
This is an administrative bill that will:<br />
· Require annual license renewal on a date specified by KREC through administrative regulations<br />
· Increase from 50 to 100 miles the radius outside of which a principal broker is required to have a broker managing a branch office<br />
· Require licensees to provide phone numbers and emails during annual renewal<br />
· Increase from 60 to 120 days after the end of the fiscal year the time frame within the commission shall make public income and expenses from the real estate education, research, and recovery fund.<br />
<br />
HB 357 – KREC Bill / Real Estate Compensation (this bill has been WITHDRAWN) <br />
· This bill will exempt employees of builders or developers who receive bonuses for sale of property and employees of property managers who receive bonuses for property management from the definition of "regular employee"<br />
· This bill also expands forms of compensation that would require a seller to issue a seller's disclosure of conditions form.<br />
<br />
HB 394 – New Home Tax Credit (SUPPORT)<br />
This bill will allow qualified buyers of new homes to utilize the new home state tax credit of up to $5,000 in conjunction with the Federal First Time Home Buyer Tax Credit of $8,000 for first time home buyers and $6,500 for repeat home buyers.<br />

<strong>SIGNIFICANT (Bills KAR will monitor)</strong><br />
<br />
HB 123 – Contracts<br />
HB 123 will require consumer contracts with an automatic renewal clause have the clause conspicuously displayed in the contract and require that notice of an upcoming renewal period be sent to the consumer. <br />
<br />
HB 219 – Crimes and Punishments (Auction Escrow Account)<br />
HB 219 relates to theft by deception to include the issuance of a check with knowledge that it will not be honored by the drawee for the lease, rent, or purchase of property, or for payment to an auction escrow account.<br />
<br />
HB 362 – Energy Star Tax Credit<br />
HB 362 expands the ENERGY STAR Tax Credit, making it available to S-Corporations, Pass-Through’s, LLC’s and LLP’s.<br />
<br />
HB 391 – Condominiums<br />
HB 391 relates to condominiums and the Uniform Condominium Act. This bill defines relevant terms, provides requirements and procedures for establishment of associations and for the conduct of business. This bill also establishes rights and responsibilities of unit owners, provides criteria related to the sale of units by unit owners and collection of delinquent fees and assessments.<br />
<br />
HB 454 – Utility Lien<br />
This bill would authorize utilities that provide gas, electric, sewer or water service to retail business customers to impose a lien on their property for any outstanding charges and fees when utility bill is in arrears in excess of $50,000. This lien would take priority over a mortgage, contract lien, or bona fide conveyance under specific conditions.<br />
<br />
HB 465 – Residential Property<br />
This bill will require a creditor to register vacant residential property with the local government in which the property is located and will create a penalty for failure to comply.<br />
<br />
HB 494 – Radon Professionals<br />
This bill is relating to radon professionals and making an appropriation thereof. This bill would require certification and regulation of radon measurement professionals, mitigation professionals, and radon laboratories as well as establish the Kentucky Board of Radon Professionals and its appointment and meeting procedures.<br />
<br />
HB 496 – Judgment Liens<br />
This bill is relating to judgment liens on real property to provide that where the real property is under joint ownership, the lien shall not extend beyond the interest held by the debtor.<br />

HB 298 – Collection of Property Taxes<br />
This bill is intended to clean up some processes that were established in last year's HB 262. This all relates to stabilizing the 3rd party purchase of delinquent tax bills.<br />

</strong>Professional standards provides our members information on issues relating to the NAR Code of Ethics and how KAR handles the Professional Standards Process for local REALTOR® Associations. Professional standards makes recommendations to KAR’s Board of Directors on policy decisions relating to many of the items listed as follows:<br />

<strong>Professional Standards Process</strong><br />
<br />
KAR abides by the Professional Standards Agreement signed by all of the 28 local boards. KAR handles the administrative paperwork for all Ethics Complaints and Arbitration Requests from Boards for all Option A Boards (Boards who delegate the administrative responsibilities to KAR). Currently 26 of 28 local boards use KAR for the process.<br />
<br />
<strong>Professional Standards Training</strong><br />
<br />
This is mandatory annual training for KAR members serving on the Professional Standards Committees. The training consists of approximately six hours of instruction and in three locations across the state. This training is necessary and mandatory for committee members to remain up-to-date on Professional Standards procedure and policy.<br />
<br />
<strong>Association Executive Professional Standards Training/Materials</strong><br />
<br />
KAR provides updated “Ethics & Arbitration Kits” (forms to mail to someone wanting to file either an ethics complaint or arbitration request) and procedures for individuals wishing to utilize the Professional Standards process. KAR invites all AE’s to attend the annual training session and also provides a copy of the most recent Pro. Stds. Reference Manual used in training professional standards committee members to ensure that all Association Executives have a thorough overview of the Professional Standards process.<br />
<br />
<strong>Mediation Training Course</strong><br />
<br />
The purpose of the one-day intensive training course and follow-up annual refresher courses is to train KAR members to serve in the capacity as Mediators in dispute resolution. It is necessary to have trained qualified mediators to offer as an option in the KAR Professional Standards process as required by NAR®.<br />
<br />
<strong>Mediation Program & Brochure</strong><br />
<br />
Mediation is offered as a service in the KAR Professional Standards process as an alternative to the formal Arbitration hearing and as a tool for dispute resolution for arbitration requests forwarded to a hearing by the Grievance Committee.<br />
<br />
<strong>NAR Professional Standards Training Scholarships</strong><br />
<br />
This scholarship sends two KAR members to the Annual NAR Professional Standards Training in Chicago for additional training in Professional Standards procedure and policy.<br />

<strong>Education Classes</strong><br />
<br />
We work with NAR and KREEF to provide information about educational opportunities to REALTORS® on the Code of Ethics. NAR requires every REALTOR® member must successfully complete an ethics class of at least 2 hours and 30 minutes. <p><strong>Filing an ethics complaint or arbitration request as a REALTOR® member or a member of the public</strong><br />
<br />
The Kentucky Association of REALTORS® ensures the ethical behavior of its REALTOR® members through the professional standards process. A complaint/request can only be processed against someone who is a member of our association and his/her membership will need to be verified in our association. Although the staff of KAR is not at liberty to offer any advice on the merits of your complaint, there are several options to consider:<br />
<br />
<strong>Filing an </strong><strong>Ethics Complaint</strong><br />
<br />
An ethics complaint may be filed by anyone who believes a REALTOR® has violated the Code of Ethics. Any complaint reviewed by the Grievance Committee must site a specific article(s) and include a statement as to why that article(s) has been violated given the facts and circumstances of the particular case. Note the complaint must be filed within 180 days (not 6 months) after the facts become known or could have been known in the exercise of reasonable diligence.<br />
<br />
<strong>Filing a Request for Arbitration</strong><br />
<br />
A request for arbitration may be filed if a contractual relationship exists between two parties and involves a specific monetary amount, which will either be awarded to one of the parties involved or split between the two parties. Note that parties subject to arbitration must agree to be bound by the award. Also the request must be filed within 180 days (not 6 months) after the facts became known or the closing of the transaction, whichever is later.<br />
<br />
Please be reminded it is important to attach an explanation of the situation surrounding the complaint/request. Be as specific as possible. Provide any information that would assistant the grievance committee in understanding the facts in the situation and making an informed decision. </strong></span>In the hopes of continuing the upward swing of the national real estate market, the recent expansion and extension of the home buyer tax credit has made more than two-thirds of current homeowners and nearly all first-time buyers eligible for the credit when they purchase a home. The credit is part of the Worker, Homeownership, and Business Assistance Act of 2009, a $24 billion economic stimulus bill that is envisioned to address the economic challenges facing our nation while also energizing the U.S. housing market.<br />
<br />
The newly passed legislation does two things:<br />
• Extends the First-Time Home Buyer Tax Credit of up to $8,000 to first-time home buyers until April 30, 2010. <br />
• Expands the credit to grant up to $6,500 credit to current home owners purchasing a new or existing home between November 7, 2009 and April 30, 2010.<br />
<br />

The Kentucky Association of REALTORS® has teamed up with associations across the country for one weekend of Nationwide Open Houses. The purpose is to encourage those who are thinking of buying a home to take advantage of unique home market factors and the federal first-time home buyer tax credit that expires on April 30th. This is the first event of its kind nationwide. <br />

Be sure to include your open houses for that weekend on the MLS and in other promotions you are putting together! We'll be directing the public to this website and you can direct them to your listings on the MLS or personal sites as well. This is at no cost to you! KAR will be sending free balloons to your local association, available for you to tie to your open house signs and will be providing free graphics, flyers and ads available for download below. NAR will be promoting the event on a national level.<br />

</strong></span>In the hopes of continuing the upward swing of the national real estate market, the recent expansion and extension of the home buyer tax credit has made more than two-thirds of current homeowners and nearly all first-time buyers eligible for the credit when they purchase a home. The credit is part of the Worker, Homeownership, and Business Assistance Act of 2009, a $24 billion economic stimulus bill that is envisioned to address the economic challenges facing our nation while also energizing the U.S. housing market.<br />
<br />
The newly passed legislation does two things:<br />
• Extends the First-Time Home Buyer Tax Credit of up to $8,000 to first-time home buyers until April 30, 2010. <br />
• Expands the credit to grant up to $6,500 credit to current home owners purchasing a new or existing home between November 7, 2009 and April 30, 2010.<br />

<em>For homes purchased between January 1, 2009 and November 6, 2009, the qualifications for the tax credit may vary. If you have specific questions or need additional information, please contact a tax professional or the Internal Revenue Service at 800-829-1040.<br />
